State of Connecticut Certificate of Employability

 

 

 

The State of Connecticut Certificate of Employability in addition to attesting to an individual’s rehabilitation efforts, can also be a shield of sorts for an employer against a negligent hiring lawsuit in the event the holder of the Certificate does subsequently reoffend. If an employer can show that (1) an applicant had a Certificate of Employability at the time of hire and that (2) the employer was aware of and considered the Certificate as part of the decision to hire and employ the holder, then the injured party may not be able to present evidence of the applicant’s or employee’s prior criminal conviction in support of the accusation that the employer acted negligently in hiring a person with such a record.
